1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of adworldnews.com (the “Site”), operated by Waymark I, Inc. (“Waymark,” “we,” “us,” or “our”) as the publisher of Ad World News. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Ad World News is a trade publication covering advertising, connected TV, and creative production, published for advertising executives, media buyers, creative and production leaders, and operators building for streaming and CTV. The publication is sponsored by Waymark; Waymark does not select, review, or approve editorial coverage prior to publication. 3. Editorial Content; No Guarantee

The Site is provided for general informational purposes relevant to the advertising, connected TV, and creative production industries. While we work to publish accurate and well-sourced content, we make no warranty that any article, interview, or other content on the Site is complete, current, or error-free, and content should not be relied upon as legal, financial, or professional advice.

4. Participation in Interviews and Coverage

Ad World News regularly invites executives, operators, and subject-matter experts to contribute to its coverage. There is no fee to participate in an interview or to be featured, and an interview invitation from Ad World News is an editorial request, not a sales solicitation or paid placement. 5. Newsletter

If you subscribe to the Ad World News newsletter, we will use your email address to send it to you, and you may unsubscribe at any time using the link in any newsletter email or by contacting editors@adworldnews.com. See our Privacy Policy for more detail on how newsletter data is handled.

6. Acceptable Use

You agree not to use the Site:

  • For any unlawful purpose, or in violation of these Terms;
  • To interfere with or disrupt the proper operation of the Site;

(as publisher of Ad World News) or its licensors, and are protected by copyright, trademark, and other intellectual property laws. You may not otherwise reproduce, republish, or create derivative works from Site content without our prior written permission.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAYMARK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU LIVE IN A JURISDICTION THAT DOES NOT ALLOW THESE LIMITATIONS, SOME OR ALL OF THIS SECTION MAY NOT APPLY TO YOU.

11. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles.

Informal Resolution First

If you have a concern about the Site, please contact us first at editors@adworldnews.com. Most concerns can be resolved this way. The parties agree to use good-faith efforts to resolve any dispute informally before either party initiates arbitration or a lawsuit.

Binding Arbitration

If a dispute is not resolved informally within thirty (30) days, either party may initiate binding arbitration. Except for small claims court matters described below, any dispute arising out of or relating to these Terms or your use of the Site will be resolved by binding arbitration administered by JAMS under its then-current streamlined arbitration rules, on an individual (non-class, non-representative) basis. The Federal Arbitration Act governs the interpretation and enforcement of this provision.

Class Action Waiver

You and Waymark agree that any arbitration will be conducted only on an individual basis and not as a class, consolidated, or representative action. If a court or arbitrator determines this waiver is unenforceable, this arbitration provision will be null and void in its entirety, and the dispute will proceed in court instead.

Right to Opt Out

You may opt out of this arbitration agreement and class action waiver by sending written notice to Waymark I, Inc., 1555 Broadway Street, 3rd Floor, Detroit, MI 48226, within thirty (30) days of first using the Site. If you opt out, Waymark will not be bound by this arbitration provision either.

Small Claims Court

Either party may instead bring an individual claim in small claims court, where that court has jurisdiction over the claim.

Exclusive Venue

For any matter not subject to arbitration (or brought in small claims court), the parties consent to the exclusive jurisdiction of the state and federal courts located in Detroit, Michigan.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last Updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
